This presentation will outline an innovative, collaborate approach to capacity to proceed. Mr. St. Aubin will discuss relevant legal considerations, effective advocacy on behalf of clients who are incapable to proceed, and the role of the defense attorney in capacity restoration treatment. Dr. Soliman will discuss the psychiatric aspects of capacity to proceed, the role of the treating psychiatrist in capacity restoration, and the role of the forensic psychiatrist as an expert witness. We will emphasize the importance of psychiatrists and attorneys working together throughout the restoration process.

Presenters:
Dr. Sherif Soliman is a Forensic and Geriatric Psychiatrist. He is Board Certified in General, Forensic, and Geriatric Psychiatry and is a Clinical Associate Professor at the Wake Forest of Medicine and Atrium Health. In addition, he holds an academic appointment at Case Western Reserve School of Medicine in Cleveland, Ohio. Dr. Soliman is the medical director of the Atrium Health Community Capacity Restoration program and the director of the Carolinas Medical Center Forensic Psychiatry Fellowship Program. He completed medical school (2000), psychiatry residency (2004), and geriatric psychiatry fellowship (2005) at Wayne State University in Detroit and has completed Forensic Psychiatry fellowship training at Case Western (2006).
Dr. Soliman serves as chair of the Geriatric Psychiatry and the Law Committee at the American Academy of Psychiatry and the Law, is a past president of the Midwest Chapter of the American Academy of Psychiatry and the Law, and has been awarded the Golden Apple Award by the American Academy of Psychiatry and the Law. This award is awarded for excellence in teaching forensic psychiatry fellows. Dr. Soliman is active in teaching medical students, residents, and fellows. He has previously served as the Associate Director of Forensic Psychiatry at Northcoast Behavioral Healthcare in Cleveland, Ohio and as a forensic psychiatrist at the Court Psychiatric Clinic in Cleveland, Ohio.
Jason St. Aubin has practiced law since 2005 and spent 17 years as an Assistant Public Defender in Mecklenburg County. Jason was hired by the Charlotte School of Law in 2009, where he worked as an Adjunct Professor until 2017. Jason taught many courses including Criminal Law, Criminal Procedure, Counseling and Negotiations, as well as Plea Bargaining. Currently, Jason works for the University of Illinois College of Law as an Adjunct Professor, coaching trial teams. Jason grew up with a disabled sister and developed a passion for advocating on behalf of the mentally ill. Two of his clients were featured in the award-winning NPR radio series “Fractured,” which detailed the difficult path that the mentally ill face during capacity restoration. He is currently a Senior Trial Attorney at Roberts, Marcilliat, & Mills.
