This presentation will begin an overview of the Rule of Evidence 702 which governs testimony by expert witnesses, focusing on why it is important in cases involving accident reconstruction evidence. Mr. Hennings will provide information about the type of work that an accident reconstruction expert performs. The program will cover important differences between investigation and reconstruction and the differences between an investigating and reconstruction officer. Strategies for challenging unreliable accident reconstruction evidence through a motion in limine and voir dire of the opposing expert will be discussed.
Using several case examples of investigations where the opinions do not meet the requirements of Rule 702, Mr. Hennings will provide examples of fabrications as well as poor work product by investigators and attorneys who failed to challenge the evidence. Examining these case examples will provide practical information about how to probe the reliability of any accident reconstruction expert’s opinion.

Since receiving a Mechanical Engineering Degree from North Carolina State University in 1997, Johnnie Hennings has held an investigative position with Accident Reconstruction Analysis, Inc. During this time Mr. Hennings has performed forensic investigations in twenty-five states. These investigations include issues related to automobile accidents, structural damage, code compliance, construction and industrial accidents, slip/trip and falls, and various engineering issues related to structural collapses, plumbing and piping failures, and other general engineering matters.
Mr. Hennings is a licensed Professional Engineer and has extensive experience and training related to crash data retrieval and analysis for passenger vehicles, obtaining and analyzing heavy truck crash data and automobile computer simulations. Mr. Hennings’ experience also includes testimony, consulting and support in criminal matters.
